This legal document is only available in Spanish. The Spanish version is the only one with legal validity under Spanish law.

Booka, Inc. additionally operates under the Bookahospi brand through its subsidiary 8Hospi Inc. (Delaware, United States of America) for the provision of services specific to the healthcare sector (hospital placement, healthcare visa management and shift marketplace). Booka and Bookahospi are complementary brands operated by Booka, Inc. and its subsidiaries, with different legal entities responsible depending on the service contracted.

2. Purpose and scope of application

This Legal Notice governs access to, navigation of and use of the website usebooka.com and all of its subdomains. Accessing the site confers the status of User and entails full acceptance of this Legal Notice, as well as of the Terms and Conditions, the Privacy Policy and the Cookie Policy.

Use of the site implies knowledge and acceptance of the legal warnings, conditions and terms of use set out in this Legal Notice. If the User does not accept the conditions, they must refrain from using the site.

3. Conditions of use

The User undertakes to make appropriate and lawful use of the website and its contents. In particular, they agree to:

  • Not use the contents for purposes or with effects that are contrary to the law, to morality, to good customs or to public order.
  • Not reproduce, copy, distribute, allow public access through any form of public communication, transform or modify the contents without the holder’s authorisation.
  • Not remove or manipulate the data identifying the intellectual and industrial property of the provider or of third parties.

4. Intellectual and industrial property

All the contents of the website — including, without limitation, texts, photographs, graphics, images, icons, technology, software, source code, artificial intelligence prompts, agent architecture, hyperlinks, trademarks, trade names, logos and other audiovisual or sound elements — are the exclusive property of Booka, Inc. or, where applicable, of the relevant third-party licensors.

These contents are protected by Spanish and international regulations on intellectual and industrial property, in particular:

  • Royal Legislative Decree 1/1996, of 12 April, approving the consolidated text of the Intellectual Property Law.
  • Law 17/2001, of 7 December, on Trademarks.
  • Directive (EU) 2019/790 on copyright in the digital single market.
  • Regulation (EU) 2017/1001 on the European Union trade mark.
  • The Berne Convention and other applicable international treaties.

The trademarks “Booka” and “Bookahospi” are distinctive signs owned by Booka, Inc. and are duly registered or in the process of being registered.

The following is expressly prohibited:

  • The total or partial reproduction of the contents without express written authorisation.
  • Scraping, crawling, mining or any form of automated extraction of data from the website.
  • The extraction, copying or reproduction of the outputs generated by Booka’s artificial intelligence agents for the purpose of training, fine-tuning or developing competing or unauthorised artificial intelligence models.
  • Reverse engineering, decompilation, disassembly or any other means of obtaining information about the internal workings of the software, prompts or agent architecture.
  • The use of the trademarks “Booka” or “Bookahospi” without express written authorisation.

Any infringement of intellectual and industrial property rights will be pursued through the civil and criminal channels provided for in the applicable legislation.

5. Exclusion of liability

Booka, Inc. disclaims any kind of liability arising from the information published on its website, provided that such information has been manipulated or introduced by an unrelated third party.

The provider shall not be liable for damages of any nature that may be caused by:

  • Interruptions, computer viruses, telephone faults, disconnections, delays or blockages in the operation of the electronic system, caused by technical deficiencies not attributable to Booka.
  • Unlawful intrusions through the use of malicious programs of any kind, whatever the means of communication used.
  • Improper or inappropriate use of the website by the User.
  • Security or navigation errors caused by a malfunction of the browser or by the use of outdated versions thereof.
  • Decisions taken by regulatory bodies, governments, hospitals, universities, employers or any other third party based on information obtained through the website.

The provider makes every effort to avoid errors in the published contents, but does not guarantee or accept responsibility for the consequences arising from them.

6. Hyperlinks to third-party websites

The site may contain links to third-party websites. Booka, Inc. assumes no responsibility whatsoever for the contents, privacy policies, commercial practices or availability of such external sites.

The existence of a link does not imply the existence of any kind of relationship between the provider and the owner of the linked site, nor the approval or acceptance of its contents or services.

7. Data protection

The processing of Users’ personal data is governed by our Privacy Policy, which complies with Regulation (EU) 2016/679 (GDPR), Organic Law 3/2018 (LOPDGDD) and other applicable regulations.

8. Cookies

The use of cookies on the website is governed by our Cookie Policy.

9. Modifications

Booka, Inc. reserves the right to make, without prior notice, such modifications as it deems appropriate to the website, being able to change, remove or add both the contents and services it provides and the manner in which these are presented or located.

10. Applicable law and jurisdiction

This Legal Notice is governed in each and every one of its aspects by Spanish law.

For the resolution of any conflict that may arise from access to the website, the User and Booka, Inc. agree to expressly submit to the Courts and Tribunals of the city of Madrid (Spain), without prejudice to the mandatory jurisdictions that may apply to the consumer in accordance with Regulation (EU) No 1215/2012 of the European Parliament and of the Council (Brussels I recast).
